1. Acceptance
By accessing or using CalcWiz (“Service”), you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.
2. Competent & Licensed Use Only
The Service is intended for use by qualified and competent persons, including licensed electricians, engineers, or suitably trained professionals. You warrant that you possess the necessary skill, knowledge, and authority to use the outputs responsibly.
3. Guidance Only – No Reliance
All outputs are general guidance only and do not constitute engineering certification, compliance approval, or professional advice.
You must independently verify all results against:
- AS/NZS 3000
- AS/NZS 3008
- Relevant amendments and local regulations
- Manufacturer data sheets
- Actual site conditions
4. Assumption of Risk
You assume full responsibility and risk arising from use of the Service, including design decisions, installation outcomes, safety compliance, and regulatory approval.
5. No Warranty
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, all warranties (express or implied) are excluded, including fitness for purpose, accuracy, reliability, or availability.
6. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, consequential, special, punitive, or economic loss.
- If you use the Service free of charge, liability is limited to AUD $100.
- If you pay subscription fees, liability is capped at the total fees paid in the preceding 12 months.
Nothing excludes liability that cannot legally be excluded under Australian Consumer Law.
7. Indemnity
You indemnify and hold harmless CalcWiz and CalcWiz from any claim, demand, loss, liability, damage, penalty, or legal cost arising from:
- Your use or misuse of the Service
- Reliance on outputs without verification
- Breach of these Terms
- Regulatory or safety non-compliance
8. Intellectual Property
All calculation logic, software, branding, and content remain our intellectual property. Reverse engineering, scraping, copying, or redistribution is prohibited.
9. Suspension & Termination
We may suspend or terminate access at any time if misuse, security risk, or breach occurs.
10. Force Majeure
We are not liable for delay or failure caused by events beyond reasonable control, including technical failure, cyber attack, or infrastructure outage.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
12. Severability
If any provision is invalid, the remainder remains enforceable.
13. Changes
We may amend these Terms at any time. Continued use constitutes acceptance.
